These General Terms and Conditions of Sale (GTC) determine the rights and obligations of the seller and the customer in the context of the online sale of personalized badges.

General provisions.

These GTC apply to any sale made through the websites of the GeekMonkey Company. The seller reserves the right to modify these terms and conditions at any time by publishing a new version on its website. The applicable GTC are then those in force on the date of payment of the order. These GTC can be consulted at the following address: www.g eekmonkey.be/cgv

Validity of offers.

Unless otherwise stipulated in writing, the validity period of our offers is 1 month from their issue.

Commands.

Any order entrusted to us is binding on us only after written confirmation from us.

Changes made by the customer to his purchase order or to our offer will only be valid on the condition of an agreement confirmed in writing.

Production will begin on the sole condition of prior payment from the customer except in exceptional cases and written by us.

GeekMonkey reserves the right to accept orders via "purchase order".

Time.

The deadlines set for our production or delivery are given, unless otherwise stipulated, only as an indication.

If a deadline is mandatory, it must be clearly specified as such on the order form. In this case, the customer may, when the delivery suffers a delay, present to a compensation which, may not exceed 10% of the total price of the order.

Even in the case, the following circumstances release us from our deadlines:

• Cases of force majeure (including, among others: strikes, technical incidents, supplier delay and labour shortage)

• If the payment terms are not respected

• If changes are decided by the client during the work.

• If the customer does not provide us with the desired information within the production time

Method of delivery and transport.

The products are delivered to the delivery address that was indicated when ordering. The delivery time does not take into account the time of preparation of the order.

We ship orders to our customers through different transport companies.The price of each delivery is calculated at the time of placing your order or when you ask us for a quote.

GeekMonkey disclaims all liability in the event of a strike and/or loss of the order by the transport services and requests customers to contact the offending company for compensation.

GeekMonkey reminds you that when the customer takes physical possession of his badges, the risks of loss or damage to the goods are transferred to him. It is up to the customer to notify the carrier of any reservation on the delivered product.

Price.

Prices are set in euros excluding VAT.

GeekMonkey offers its customers the delivery of badges if it is in the European Union.

A price all tax included (TTC) is communicated when the customer orders and on the order confirmation that he receives through our services.

Availability.

Orders are processed within the limits of our available stocks and subject to stocks available from our suppliers. In case of unavailability of an item for a period of more than 10 working days, you will be immediately notified of the foreseeable delivery times and the order of this item may be canceled on request. The customer can then request to have an equivalent item or a refund of his order.

Payment.

Invoices are payable at the time of the order and at the latest 8 days after receipt of the package except in exceptional cases mentioned in writing on our part.

After this period, any unpaid invoice will produce, automatically and without formal notice, a conventional interest of 12% per year, with a minimum compliant rate provided for in Article 5 of the Law of 2 August 2002 on late payment in commercial transactions.

Any unpaid invoice within 60 days will also be increased, by operation of law and without formal notice, by a fixed and irreducible compensation of 15% of the unpaid amount with a minimum of € 50.-per invoice.

Any dispute relating to an invoice must be sent to us in writing, within seven working days of its sending.

Guarantees.

We guarantee the products we sell against hidden defects for a period of one month from delivery. This warranty is subject to the following conditions.

The guarantee can only be implemented if the following conditions are met:

• The defect renders, to a significant extent, the product unfit for the use for which it is usually intended or for a special use expressly mentioned when ordering.

• The product has been used appropriately.

To be able to invoke the benefit of the guarantee, the buyer must notify us of any claim relating to hidden defects by registered letter within a maximum of ten working days after receipt of the goods.

Our warranty is limited, at our option, to the replacement of defective goods. Under no circumstances will these be refunded. The buyer must return at his own expense and risk the unusable goods to our offices for replacement. We will bear the costs of returning to our establishment and the costs of returning to the customer if the material proves to be effectively unusable.

Intellectual property rights.

Trademarks, domain names, products, software, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of the seller. No transfer of intellectual property rights has been made through these GTC.
